Who Pays For Aviation Disasters By Catherine Harvey
When it comes to personal injury lawyers, there can be none that need to be more specialised than those that deal with major aviation disasters. The red tape that surrounds these occurrences would be insurmountable for those who didn't know what they were dealing with. Many of the accidents occur overseas and once you are out of the EU, laws are completely different.
A personal injury lawyer would need to be adept when it comes to knowledge of law in foreign countries. They would need to be able to interpret the foreign language and break down barriers that might otherwise prevent the victim's families of gaining any form of compensation.
I say victim's families because one of the biggest tragedies of aviation disasters is that there are very rarely survivors. Families will be united in grief and will be in immediate need of answers. Knowing who to turn to in such an instance is problematic to say the least. Switchboards are jammed, language is a barrier and when you finally find someone to talk to, they cannot give out any information.
This is where a specialised personal injury lawyer will come into his own. They are well equipped to deal with authorities as well as showing the compassion needed for the victims and their families. Oftentimes, you will find one group of injury lawyers will be assigned to a whole aviation disaster as opposed to many different companies getting involved and this can work better for the victims as a whole team will be on the case consistently.
One such case happened to occur recently in the Sudanese capital, Khartoum. Shortly after landing, the airliner burst into flames killing at least 28 of the 217 passengers on board. It is thought that there was an explosion in the airliner's right wing engine as is made its way towards the airport terminal, causing confusion, panic and chaos among the passengers, many of whom fled and have yet to be accounted for.
So far, authorities are blaming weather conditions for the fire but investigations will be carried out as a technical fault cannot be ruled out. These investigations take time and the families of the victims will need patience to get to the bottom of the accident. All families are entitled to some form of compensation, particularly if a mechanical fault is found as no-one expects to be flying in an aircraft that doesn't appear to have passed all its safety checks.
There can be nothing to top of aviation disaster of 9/11 when terrorists used airliners as weapons and flew them into strategic points across America wiping out hundreds of lives and changing our view of so many things for so long. The injury lawyers have had massive amounts of work cut out securing compensation for the thousands affected by this event.
PanAm airways saw a plane go down in Tenerife in 1977. The 583 deaths from that disaster made it the second biggest aviation disaster of all time with Japan Air Lines losing 520 over Mount Osutaka in 1985. Improper maintenance procedures were found to be responsible for the loss of just under 300 people at Illinois when an American Airlines DC-10 lost an engine just after take-off and crashed. Finding such human error responsible for an aviation disaster makes the whole process of claiming compensation much easier for the injury lawyers involved and everybody dreads a disaster of such magnitude, it is an unsavoury fact of life and one that calls for a specialist group of personal injury lawyers.
